Minutes of 12.20.2021

A regular meeting of the Town of Denmark Town Board was held on December 20, 2021, at the Town of Denmark Municipal Building.  A Zoom meeting connection was provided for the interested public to attend the meeting remotely if they wished. The NYS Tug Hill Commission offered their assistance and expertise to set up the meeting for the Town of Denmark Town Board. The link for the meeting was posted on the Town of Denmark website, the three US Post Offices located in the Town and was provided to the media.

The meeting was opened by Supervisor Der at 6:00pm.  Those in attendance recited the Pledge of Allegiance.

Supervisor Der asked Clerk Greene if she knew why claim 257 for Eastern Shore Associates, was higher than expected.  Clerk Greene explained that the Cyber policy had been broken away from the old policy and re-written to accommodate the changing legislation regarding coverages for cyber liability.

A question from Councilman Jones about 214 from Supt. Mahar.  Supt. Mahar explained.

 

Supervisor Der asks Clerk Greene if the UniFirst contract runs for two or more years at a time.  Clerk Greene answered that she would need to look at their contract to see how long it does run.  Supervisor Der asks Supt. Mahar if UniFirst is performing better since he spoke with them.  Supt. Mahar replied that they are.

Department Reports:

Dog Control Officer: DCO Astafan’ s report for December 2021 was provided to the Town Board prior to the meeting.  No questions for dog control.

 

Justice Kiernan enters at 6:11.

Zoning & Planning Board:  Report for November was provided to Board Members prior to meeting.

Councilman Fazio raised concerns about Simmons Tree Farm on Rt 12, the parking for the business was discussed.  Without new Special Permit, Planning Board has no authority.

Discussion was held on the development agreement reimbursement for the East Road Solar Projects owned by Green Street Power Partners, LLC.  Bills are still outstanding from Barton & Loguidice for their review of the SWPPP plans for the projects on East Road.

Assessor Report:  Town Assessor, William Vargulick informed Town Board that the State is changing the way special districts are taxed in 2023.  Discussion was held.  Supt. Mahar suggested the Town send a letter to State representatives opposing these changes, further discussion held.  Assessor Vargulick will have further information next month.

Discussion was held about Dollar General assessment sale price.

Supervisor Der discussed court duties with the Board.  Justice Kiernan was there at the request of Supervisor Der to advise the board what the Town’s options might be given Justice Hancock’s recent resignation.  Because Town wanted both Justices discussion was held.  Justice Kiernan urged Town Board to seek second justice, he will also reach out to Judge Gideon at NYS.  Until another Justice is found, Justice Kiernan will continue to handle traffic and criminal.

Councilman Doyle asked Justice Kiernan if he is aware of anyone that might be looking to become a bailiff?

Councilman Jones thanks Justice Kiernan for his service to the community.

Town Clerk:  Clerk’s report for November 2021 was provided to the Town Board.  There were no questions of the November report. Included with the Clerk’s report:

Letter Dated 12.14.2021 – Resignation of Justice Jason J. Hancock

Clerk Greene gave an update in progress made to for the change in website host.

Clerk Greene discussed the resignation of Hancock from office.

Clerk Greene discussed with the Town Board the handling of the monthly audit of Justice Hancock’s records.  Justice Hancock never handled a case or any money for the Court.  His resignation came while he was still completing the required training.  Clerk Greene has notified the State of the resignation.

Assessor Vargulick removes himself from the meeting at 6:34.

 

Supt of Highways Report:  Supt. Mahar updated on the activity of his department:

Cleanup from the windstorm, cold patching and chipping.  Discussion was held on the wheeled excavator purchase.  The financer of the equipment submitted a resolution they would like the Town to adopt for the financing.  Copies were provided.

Supt. Mahar was asked what roads would be included in the nearly 70 miles of repairs.  Supt. Mahar stated Halifax Road, Roberts Road, Carlowden Road.  Councilman Wadsworth asked Supt. Mahar about the culvert, Supt. Mahar answers yes.  Supt. Mahar will not know what repairs can be made until the final budget is passed.

Resolution 122 of 2021: Signing of Section 284 Agreement

The Town of Denmark Town Board hereby authorizes and directs that the Section 284 agreement be signed by Town of Denmark Board members and the Town Supervisor to allow Supt. Mahar to perform up to $100,000.00 of repairs on 69.90 miles of Town Roads including sluices, culverts and bridges having a span of less than five feet and boardwalks or renewals thereof.

Resolution 123 of 2021: Purchase of Used Bucket Truck

The Town of Denmark Town Board Hereby Resolves to allow Supt. Mahar to purchase Lewis County’s used bucket truck with the Town of Pinkney with each Town contributing $5,000 for a total cost of $10,000.  Town of Denmark will make the purchase from Lewis County of the equipment with Town of Pinkney reimbursing Town of Denmark their share of $5,000.00.    The purchase will be drawn from the 2022 Budget.

Supt. Mahar discussed the need of a Deputy Supt. Of Highway due to not having a Shop Foreman.  This position would have no salary.  Discussion held.  Concern was raised by Councilman Doyle about no salary being paid.  Discussion held.  Supt. Mahar would like the position to start 1/1/2022.

Resolution 124 of 2021:  Creation of Deputy Supt. Of Highway, a non-paid position

The Town of Denmark Town Board Hereby Resolves to allow Supt. Mahar to appoint a Deputy Supt. Of Highway, a non-paid position to start January 1, 2022.

The Town of Denmark Town Board recognizes the receipt of revenue from Federal ARPA funding and would like to use part of that Federal ARPA funding for the purchase of a Tate radio system for the Village of Castorland Fire Departments newly purchased ladder truck and four (4) handheld radio units to promote public safety.  The Town of Denmark Town Board hereby directs the following budget adjustments:

  • Increase revenue in General (A) Fund: A4089 $10,200
  • Increase expenditure in General (A) Fund to show transfer of ARPA funds to Fire Protection (SF) Fund: A9901 $10,200
  • Increase revenue in SF Fund to receive funds transferred from General Fund for ARPA revenue: SF5031 $10,200
  • Increase expenditure in SF Fund to show expenditure for equipment purchase: SF3410.2 $10,200

The Town of Denmark Town Board hereby authorizes and directs that the previously adopted 2021 Town of Denmark budget be amended to include increased revenue received from the State of New York for CHIPS Funding in the amount of $69,098.50, budget code DB3501, and that the revenue be directed towards increasing the expenditure line DB5112.4 by $69,098.50.

Supervisor Der started a discussion about the town attorney.  Burrows is leaving Conboy, McKay, Bachman and Kendall firm.  Trustee Vogt confirmed Village has appointed CB Law firm as council of FD matters.  Discussion held.  Village also has Joe Russell for all other matters.  Discussion held to appoint Jim Burrows as town attorney.

Supervisor Der suggested that change is coming from health insurance companies on the ambulance reimbursements.

 

Old Business: 

 

Copenhagen Wind – Supervisor Der contacted June Lee about Satellite issues experienced.  No response.

ARPA Funding – What is not spent in one year can be rolled to the next year, must be spent by end of 2026 budget year.

Door Replacement Project – Councilman Doyle will follow up in 2022 after the holidays.  Discussion held.  Doors do not need to be fire rated.

Upon retirement, the employee’s cell phone may go with the retiree.  It is the retirees’ option to keep the assigned phone number and phone but will become the sole responsibility of the retiree, therefore, must transfer said phone and/or phone number to their own billing account.

Councilman Doyle reminds interested members that the Tug Hill training seminars will be at Turning Stone this year.

Councilman Jones asks where we are with RACOG and new website.  Clerk Greene explained that she is working with Advanced Business Systems and Mickey Dietrich with RACOG.  Clerk Greene has established a GoDaddy account for the transfer of the domain name.

Supervisor Der asks Clerk Greene if the UniFirst contract runs for two or more years at a time.  Clerk Greene answered that she would need to look at their contract to see how long it does run.  Supervisor Der asks Supt. Mahar if UniFirst is performing better since he spoke with them.  Supt. Mahar replied that they are.

Department Reports:

Dog Control Officer: DCO Astafan’ s report for December 2021 was provided to the Town Board prior to the meeting.  No questions for dog control.

 

Justice Kiernan enters at 6:11.

Zoning & Planning Board:  Report for November was provided to Board Members prior to meeting.

Councilman Fazio raised concerns about Simmons Tree Farm on Rt 12, the parking for the business was discussed.  Without new Special Permit, Planning Board has no authority.

Discussion was held on the development agreement reimbursement for the East Road Solar Projects owned by Green Street Power Partners, LLC.  Bills are still outstanding from Barton & Loguidice for their review of the SWPPP plans for the projects on East Road.

Assessor Report:  Town Assessor, William Vargulick informed Town Board that the State is changing the way special districts are taxed in 2023.  Discussion was held.  Supt. Mahar suggested the Town send a letter to State representatives opposing these changes, further discussion held.  Assessor Vargulick will have further information next month.

Discussion was held about Dollar General assessment sale price.

Supervisor Der discussed court duties with the Board.  Justice Kiernan was there at the request of Supervisor Der to advise the board what the Town’s options might be given Justice Hancock’s recent resignation.  Because Town wanted both Justices discussion was held.  Justice Kiernan urged Town Board to seek second justice, he will also reach out to Judge Gideon at NYS.  Until another Justice is found, Justice Kiernan will continue to handle traffic and criminal.

Councilman Doyle asked Justice Kiernan if he is aware of anyone that might be looking to become a bailiff?

Letter Dated 12.14.2021 – Resignation of Justice Jason J. Hancock

Clerk Greene gave an update in progress made to for the change in website host.

Clerk Greene discussed the resignation of Hancock from office.

Clerk Greene discussed with the Town Board the handling of the monthly audit of Justice Hancock’s records.  Justice Hancock never handled a case or any money for the Court.  His resignation came while he was still completing the required training.  Clerk Greene has notified the State of the resignation.

Supt of Highways Report:  Supt. Mahar updated on the activity of his department:

Cleanup from the windstorm, cold patching and chipping.  Discussion was held on the wheeled excavator purchase.  The financer of the equipment submitted a resolution they would like the Town to adopt for the financing.  Copies were provided.
